Terms of Use

1. Agreement

These terms apply to the Podland iOS application and the backend service it talks to, together "Podland". By installing or using Podland you accept them. If you don't accept them, delete the app.

Podland is provided by Steven Aranjo as an individual. It is not a company, and there is no organisation standing behind it.

2. What you get

Podland is provided free of charge for your personal, non-commercial use. There is no fee, no subscription, and no purchase of any kind. You are granted a personal, revocable, non-transferable licence to use the app on devices you own or control.

Distribution is currently through Apple's TestFlight, which is beta software distribution. Beta builds expire, may contain defects, and may behave in ways a finished release would not.

3. Podcast content is not ours

Podland is a player. Podcasts, their audio, artwork, titles, and descriptions belong to their publishers and rights holders. Podland does not own, licence, endorse, or take responsibility for any of it, and does not curate or recommend shows. You choose which feeds to add.

The backend retrieves and temporarily stores episode audio in order to locate advertising breaks within it, and serves that copy back to your app. It does not publish, redistribute to the public, or make that audio available to anyone other than the installs that requested the episode. If you are a publisher and want your feed excluded, write to the address at the bottom and it will be.

4. Ad skipping

Smart Ad Skip is off unless you switch it on, and it works by estimating where advertising sits inside an episode. It is not perfect. It will sometimes miss an advertisement and will sometimes skip a portion of the programme itself. No promise is made about its accuracy, and you accept that imperfection as a condition of using the feature.

Skipping happens locally on your device during playback. Podland does not modify, re-encode, or redistribute a publisher's audio file, and does not remove or alter anything in the file itself.

5. Acceptable use

You agree not to:

• Use Podland for anything unlawful, or in breach of a publisher's own terms.
• Attempt to gain access to parts of the backend you were not granted, interfere with it, or probe it for weaknesses.
• Place automated or excessive load on the service, or use it as general-purpose media hosting or a download accelerator.
• Extract, share, resell, or reuse the credential the app holds, or use it from anything other than a Podland install.
• Redistribute the app or resell access to the service.

Access may be revoked, for a single install or entirely, if the service is being abused. Given the scale involved, this is a judgement call made by one person rather than an appeals process.

6. Availability

Podland runs on a single server paid for personally. There is no uptime commitment, no service level agreement, no support obligation, and no guarantee of any kind that it will be running tomorrow. It may be taken down, changed, restricted, or discontinued at any time, with or without notice, and features may be removed as readily as they are added.

Downloaded episodes stay playable on your device if the service stops, and you can export your subscription list at any time from Settings.

7. No warranty

Podland is provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. You use it at your own risk.

8. Limitation of liability

To the fullest extent the law allows, Steven Aranjo is not liable for any indirect, incidental, special, consequential, or exemplary damages, nor for any loss of data, missed content, lost time, or device issues arising out of your use of Podland. Because Podland is supplied free of charge, total liability for any claim relating to it is limited to zero.

Some jurisdictions do not permit the exclusion of certain warranties or liabilities. Where that is so, the exclusions above apply only to the extent permitted, and your statutory rights as a consumer are unaffected.

9. Privacy

What is recorded, and what is not, is set out in the privacy policy, which forms part of these terms.

10. Apple

Apple is not a party to these terms and has no obligation to provide support for Podland. Any claim relating to the app is directed to Steven Aranjo, not to Apple. Where Apple's own standard terms for licensed applications apply to a distribution of Podland, they apply alongside these terms, and Apple is a third-party beneficiary entitled to enforce them.

11. Ending it

You can stop using Podland at any time by deleting the app. This licence ends when you do. Sections 3, 7, 8, and 12 survive that.

12. Changes and governing law

These terms may change; the date at the top will change with them, and continuing to use Podland after a change means accepting it. These terms are governed by the laws of the United States and the State of California, without regard to conflict of law rules, and the courts of California have exclusive jurisdiction, except where mandatory consumer protection law in your own country gives you the right to bring proceedings locally.

If any provision is found unenforceable, the rest stays in force.
